A bit about Contractor insurance

Contractor insurance is usually is taken out by a Contractor to protect themselves’ against potential risks and liabilities that could arise as a result of the services provided under the contract.

The type, scope and complexity of insurance cover required is usually dependent on the type of services to be provided under the contract; for instance a Contractor providing ‘building services’ will have very different and far more complex insurance needs to that of a Contractor engaged in a community ‘clean-up operation’ such as Contractors who clean up parks and public areas after a community event.

However, both types of Contractors will have to have some broad form of Public Liability insurance cover as an initial starting point.

The major difference between Contractors & Sub-Contractors

Contractors – are independent and provide their services to Clients subject to the terms of agreement set out in a ‘contract’ between the Contractor and the Client. The ‘contract’ will set out the terms, conditions and obligations of each party to the other; including in respect to such matters as liabilities and limitations of such between the parties; i.e, ‘ABC123 Pty Ltd’ trading as ‘Bob’s Bobcats & Earthmoving’ hereinafter referred to as the Contractor’ agrees to provide……..services….to Mr John Smith hereinafter referred to as the ‘Client’ 
 
Sub-Contractors - will usually provide their services to the Contractor but, will not necessarily be a party to the contract between the Contractor and the Client. In most cases, the Sub-Contractor will need to have their own Sub-Contractors liability insurance cover as they will not usually be included under the Contractor’s insurance cover; nor for that matter under the Client’s insurance cover if the Client has any.

Contractors and Sub-Contractors need their own insurance cover.

Navigating the fine print

There are many Exclusions and Limitations to ‘standard Contractors insurance cover given the many variables of  work performed under contracts.

For instance, most ‘standard’ Contractor insurance policies exclude the following events unless specifically endorsed as additional cover on the policy.
